The answers, without the runaround

Yes. Section 55 of the Maharashtra Rent Control Act, 1999 makes registration of a Leave and Licence agreement mandatory, and it places that duty on the landlord. An unregistered agreement is not evidence in most proceedings, and the penalty for non-registration can run to three months’ imprisonment or a fine up to five thousand rupees. In practice the bigger cost is quieter: banks, schools, passport offices and gas agencies will not accept an unregistered agreement as address proof.
No. Maharashtra allows Aadhaar-based e-registration, and as an authorised service provider we bring the approved biometric device to you. Landlord, tenant and both witnesses complete their thumb impressions at your home or office. Nobody visits a government office at any stage.
Drafting is same-day once we have complete particulars. The biometric appointment is usually within one to two days of you approving the draft. The registered document is typically emailed within five to six working days of biometrics, though it often arrives sooner. If the government portal is down — which happens — we tell you rather than letting you wonder.
The law puts the duty to register on the landlord. Who actually pays is a matter of negotiation and varies by locality: in much of Thane and Mumbai the tenant pays, in other pockets it is shared. We are happy to invoice whichever side you tell us to.
Aadhaar and PAN of the licensor, the licensee and two witnesses; proof of the property such as a recent electricity bill, property tax receipt or Index-II; and the commercial particulars — rent, refundable deposit, tenure, start date, built-up area, lock-in and notice period. The device used is a government-approved fingerprint scanner and the authentication goes directly to the Department of Registration and Stamps portal. RentODoc does not store your biometric template. It is used for that one authentication and nothing else.
Both situations have a route. Where Aadhaar is unavailable, registration can proceed through the conventional identification process at the Sub-Registrar office with a photograph and ID. Where fingerprints do not read — common with elderly parties or heavy manual work — iris authentication is used instead. Tell us beforehand and we plan for it rather than discovering it at your dining table.
Under Article 36A of the Maharashtra Stamp Act the duty is charged on a value made up of the total rent for the whole term, plus any non-refundable deposit or premium, plus ten per cent of the interest-free refundable deposit for each year of the term. On that total, duty is 0.25% for a term up to sixty months and 0.50% above it. Our calculator does this on your real numbers and shows every line so you can check the arithmetic yourself.
A registration fee of one thousand rupees for property inside a municipal corporation area, or five hundred rupees outside it, plus document handling charges of three hundred rupees for e-registration. These are fixed by government. They are not our fee and they do not change with the value of your agreement.
Because the base value is different. A higher rent, a bigger refundable deposit or a longer tenure all raise the taxable value, and a term over sixty months doubles the rate. Two flats in the same building can differ by thousands for those reasons alone.
Our fee is quoted as one all-inclusive figure for the area we serve, with the doorstep visit already inside it. If your property is well outside the Mumbai Metropolitan Region we will say so before you commit, not afterwards.
For a party elsewhere in India, biometrics can be arranged at their location — tell us the city and we plan the visit. For a party abroad, the usual route is a Power of Attorney executed in favour of someone in India, which we help you set up correctly. Either way, tell us early; it changes the sequence, not the outcome.
Yes, and it is common for commercial licences. We need the certificate of incorporation, the company PAN, a board resolution or authority letter naming the signatory, and that signatory’s own Aadhaar and PAN. The signatory completes the biometric on the company’s behalf.
Yes. Eleven months is a habit, not a rule — it comes from a time when longer tenancies attracted rent-control protections landlords wanted to avoid. Under the current Act you can register for any term you both agree. Just note the sixty-month line: cross it and the stamp duty rate doubles from 0.25% to 0.50%.
Police authorities across the Mumbai Metropolitan Region require landlords to submit tenant verification, and local orders are issued periodically making it enforceable with a penalty. It is separate from registration and is decided by the police, not by us. We prepare the form correctly and help you submit it — but the outcome and the timeline sit with the authority.
